At Pobi Lawyers, we know that lot owners and owners corporations want an experienced strata lawyer who is flexible, accessible, offers budget certainty, value for money and an efficient means of assisting them in resolving their strata disputes.

To assist our clients, we charge a fixed fee for all types of Strata Adjudication matters which includes the following stages of work:

(a) obtaining the client’s instructions;

(b) drafting and preparing Strata Adjudication Application, Submissions and Evidence;

(c) drafting Submissions in Response (in defended matters);

(d) drafting and sending letters to the NCAT registry and all relevant parties;

(e) lodging Strata Adjudication Application, Submissions and Evidence; and

(f) reporting to the client on the Strata Adjudicator’s decision and the next steps.

We also enjoy working as a team with our clients and involve our clients in all aspects of scoping of work, milestones and budgets. We also appreciate that some lot owners want to do the majority of the leg work such as the preparation of draft witness statements and the indexation and collation of documents so as to reduce costs which is fine by us.

Our clients find that charging a fixed fee for the above scope of work gives real price certainty and is attractive in cases where there is a strong possibility that an owners corporation will not settle at mediation and will just take them all the way.

The way in which we calculate our fixed fee is as follows:

(a) a fixed fee for the whole matter or stages of a matter; and

(b) a capped fee.

His personal experience living in a 12-lot strata scheme for 13 years, including 2 years serving on the strata committee, gives Michael unique, firsthand insights into the everyday complexities faced by his clients.
